What is a Spousal Open Work Permit?

A Spousal Open Work Permit (SOWP) allows the spouse or common-law partner of certain Canadian workers and students to work for any employer in Canada — without needing a job offer or Labour Market Impact Assessment (LMIA). It provides family units the opportunity to both work and live together in Canada.

Who is Eligible for a Spousal Open Work Permit?

Your spouse or common-law partner must be one of the following:

• Skilled worker on a work permit — Working in a NOC TEER 0, 1, 2, or 3 occupation with at least 6 months remaining on their permit
• International student — Enrolled full-time in a Designated Learning Institution (DLI) at the master's, doctorate, or professional degree level
• International student at other levels — Only eligible if the program is over 16 months at a qualifying DLI

Documents Required

• Valid passport
• Proof of relationship (marriage certificate, cohabitation evidence)
• Copy of spouse/partner's valid work or study permit
• Employment letter confirming NOC TEER category (for worker sponsors)
• Proof of enrollment and duration (for student sponsors)
• Photos and digital copy of passport
• Biometrics (if not already on file)

How to Apply

Most SOWP applications are submitted online through the IRCC portal. You can apply from outside Canada (and enter once approved) or from within Canada if you are already on a valid status. Applying from within Canada is called an extension or change of status.

IRCC is currently processing spousal open work permit applications in approximately 3–5 months online. However, processing times vary significantly depending on your country of citizenship and the volume of applications. Applicants inside Canada may be eligible for Maintained Status while waiting.
